Kia Ora. I have a female client in Bay of Plenty New Zealand
I have a female client in Bay of Plenty New Zealand who has an informal arrangement with partner for her to see their 3 sons (ages 6, 8, 10) - she works different evening shifts (8 pm to 7 a.m.) 4 nights a week which changes week to week - her partner has been the main carer for over 12 months now and he has decided she cannot have the children to stay overnight or to visit until she gives him regular days and nights. My son Dean separated from his wife about 2.5 years ago.
My son Dean separated from his wife about 2.5 years ago. They have 2 children aged 8 and 5yrs. Over the last 18 months a mutually agreed parenting agreement has been in place. Under this agreement Dean has the children from Friday afternoon until Tuesday morning once every 2 weeks. His wife now has a new partner and has had another child with him. She is not in paid employment, and does not want to be. Every few months she threatens to go to the IRD for child support. (She actually did apply and receive child support prior to the parenting agreement being in place). Dean is currently finalizing the purchase of a house (he has been living with my wife and I). With living and mortgage costs he will not be able to afford to pay child support with the current split in custody and the fact that he is working and she is not. Ideally he would like to share custody and costs 50:50, (they already share school fees 50:50), and also share working for families benefits of which he currently sees none. What options are there for pursuing more equitable arrangements through the courts? Regards, Jeff … read more
