My son's grandmother passed a wk ago. She left my son $2,500…

Customer Question
My son's grandmother passed...

My son's grandmother passed a wk ago. She left my son $2,500 in a ins policy. The sister(His Aunt) is over the estate. She told my son she needed the 2,500 to help with the funeral expenses. We do not know how much money is in the estate. She only told him she only had 2,000 and she needed his money to help out. We only have her word that there is very little money in the estate. His grandmother told him that she had left him an ins. policy. Is there a legal way for my son to find out how much is in the estate?.and do she have a legal right to ask my son to sign over his inheritance to her for the funeral. Thank You. SGM. USA Ret.

Lawyer's Assistant: Estate laws vary by state. What state are you in?

His Grandmother lives in Texas and my son lives in New York.

Lawyer's Assistant: What documents or supporting evidence do you have?

His name is ***** ***** ins policy

Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?

Do my son have a legal right to look into his grandmother estate to see if there is enough money for his grandmother funeral. He is only being told they need his money to help with the funeral.

My sympathies for your family's loss.
A life insurance policy passes outside of probate directly to the named beneficiary so the executor has no authorit over those proceeds.
When a person does with a will probate is open and that is a public record so a person can obtain a copy of the will. The executor has a fiduciary duty to the estate and must keep heirs reasonably informed and provide a copy of the will upon request.

I was looking on harassment : No, Not as of yet : I'm am
I'm am being harassed by my BN SGM. It all started in January when our unit was scheduled to deploy. I was deemed non deployable due to an ongoing medical condition (Asthma). In February, even though I was not cleared by SRP to deploy, I was told that I was deploying anyway by my SGM. I brought all my items in and packet the in the connex. I later had a meeting with the BN CDR who requested all my medical information. I informed him of my medical condition and that I needed to see a specialist and he stated that I will still be deploying. Because of all the stress around this I informed the unit that I wanted to submit my retirement packet. My health was not we're it use to be and it was time for me to consider leaving the Army. The SGM returned and denied my packet stating that I can't submit a retirement packet until she tells me to and that it won't happen until after I return from the deployment. Now, the packet was resubmitted and the BN CDR had to get involved to ensure its being processed. Now, I'm still not medically cleared and am being counseled on not having a profile. Which the unit is now saying I'm deemed deployable but the medical doctor indicated to the unit a waiver would be required. Also, now I'm being told I can only attend the mandatory class for ACAP which are only five classes. I'm not trying to be one to complain I just want the same standard across the board. We have had four people ETS or be chaptered out of our unit and no one has been counseled or told they can only attend mandatory ACAP classes and I'm about to retire. We've had four people who were scheduled to deploy and were medically unfit and didn't receive a counseling about a profile. I'm given more work than others in the office that requires me to stay late and I don't complain. I'm in need of some advise. Im not really sure how much more I can take. … read more
