The DVA just turned down my entitlement to benefits for a

The DVA just turned down my entitlement to benefits for a heart condition,back condition and degenerative right shoulder that were mentioned in my military medical records. They cited that "evidence does not show a chronic disability during service nor after active service". I still have the same heart condition and have had surgery on my shoulder and back. I will put in a notice of disagreement. Can I sue the DAV? Thank you, ***** ***** CDR USN retired

SOrry...I want to make sure I mention both DVA and DAV...two separate organizations. Can you clarify...who are you trying to sue??
