Actually, if the person is a military retiree, there is no prohibition from them investing in marijuana growing businesses or dispensary businesses. The retiree could not be prosecuted under the UCMJ for this investment. The federal government might pursue regular criminal prosecution, because it still is illegal under federal law, but those prosecutions in states where marijuana is legal has been very rare. You would not lose your retirement and benefits though over this.
