I am going through a divorce my boyfriend is army they want to charge him with adultery he did not know I was going to a divorce he thought it was done can they charge him

Yes, they can charge him. Legally, you were married and were not divorced.

Now, he can certainly raise as a defense that he was not aware that you were still married and thought it was done. If he is believed, the members would not find him guilty.

But his belief doesn't actually stop command from charging him.
