You are not required to send a letter, but, in my opinion, it is best to send a letter so that there is documentation that you have made the request before deciding to file suit. You can simply just file suit, but if you think that there is a possibility that the letter may help obtain an agreement that you can live with, then, by all means send a letter.
It certainly can be considered insurance fraud, and you may want to make a report to the department of insurance regulation in that state, and they will open up an investigation.
