Your question says you wanted someone to review the docket, but you posted an order. I'm just wondering if there's something the docket you also want reviewed.

The docket is a list of all filed documents in the case. I have not received that. The order says that the defendant is required to file substantive responses to the listed Interrogatories questions and send a copy to the plaintiff. It also says that he isn't allowed to submit objections to the interrogatories at this point--that's important, because any objection stated now could result in a contempt of court charge.

The listed interrogatories are:

3-5, 11-12, 14-16, and 22-24.

Then it also says that the defendant needs to provide responses to the following Requests for Admission:

1, 8, 15, 17-18, 22, 25-29, 31, 34-35, 45-47, 49-55, 57-59, 62-66, 69-70, 72-73, 79-80, 82-83, 85(1), 90, 92-93, 98, 100-102, and 110.

Similarly, you're not allowed to object at this point. You're allowed to deny any request for admission that is not 100% factually accurate. But if you object, the judge might consider the requests admitted, and you don't want that.

Third, the order requires the defendant to defend the allegation that he is in contempt of court. The allegation is that you were supposed to mail something to her and didn't. Contempt requires three elements:

1. A valid court order

2. ability to comply, and

3. intentional failure to do so.

Usually the response to a Motion for Contempt would be either that you are not physically able to comply (like if they ordered to you pay a million dollars you don't have), or that any failure to follow the order was accidental/unintentional. If you didn't have the documents to mail, that would be a defense. Or if you made reasonable efforts to get them and they never arrived. Something like that.

That's going to be three separate documents.

The judge also wants proof that you mailed the documents. If you're not able to submit that, it makes it more likely he will find  you in contempt of court. Contempt sanctions are at the court's discretion. If a discovery dispute becomes prolonged, the judge can order that the party in contempt isn't allowed to produce evidence on certain issues--and that will significantly hinder the defense.
