I have a particular question that is broad in nature but I simply need one outlying answer. I am elderly, 62, retired. My spouse is a few years younger than me. I've never been in trouble in my life, never a legal issue, no spousal issues, no PFA, etc. I've encountered a particular family matter that has embroiled into chaos, with my wife siding with my daughter and her son in law on my state of being. Just days ago, in a discussion that turned into an argument with my wife, she left our home stating she was going over to our daughters house. Hours passed, almost 4 hours to be exact. The next thing I know, I am in my home, it's 11:30 pm and our township police come to my front door with a court ordered, Pennsylvania Code 302 Mental Health Committal Form. I was taken away by police/ambulance and transported to a local hospital for mental evaluation under a very stringent PA MH302 Code. My wife went to the authorities sometime during that period and filed this saying that she feared for her life because she feared I was going to harm her and commit suicide on myself. It was an argument we had, no threats, no violence, etc. After intake evaluation the decision was made that I did not belong there. I had to work to undo the PA302 Code against me with the medical staffs help, circumventing the court order filed by my wife. I was release the next day. This filing by my wife was done as an harassment attempt and possibly some type of a strategy attempt. This Mental Health 302 Pennsylvania Code/Law is a very dangerous tool. After finding out much information about it I am trying to find out if it can be used again and again against a person? The hospital psychiatrists, psychologists, clinical staff all assessed me and felt that if anything, I was encountering a huge amount of stress. I accepted their offer of therapy, along with my wife. I am scared now that this law could be misused against me by my wife and possibly daughter as a random tactic for their own personal reasons of retribution of some sort against me. … read more
