Case Law for Motion to Dismiss

The Colroado Court of Appeals dismissed my civil appeal without any explanation. I submitted a motion for clarification of its Order dismissing my case. And I also submited a contemporaneous motion for rehearing. The court of appeals denied my motion for rehearing again without any clarification or explanation. And further the court of appeals did not answer my motion for clarification; as to why it dismissed my appeal in the first place. The state court has subjected me to numerous illegal orders as well as to violations of constitutional rights; which began with the district court illegally usurping the Colorado Supreme Court's orginal jurisdiction in a matter that the state court should never have even considered and ruled on in the first place. My next step is to the Supreme Court. However, I would like to first file a CAR 21 motion before filing my Certiorari petiton. Thus my question is this. Will the filing of a CAR 21 motion affect my right to file for certiorari? Or will the CAR 21 motion stay the time limit to file for certiorari or other Supreme Court actions? Please advise. Customer: Yes
JA: What steps have you taken so far?
Customer: I filed an appeal on the district court's order. But the court of appeals dismissed the appeal because it said that the order I am appealing from is not a final appeal. Even though the district court says it is final. i then filed a motion for rehearing to the Colorado COA along with a contemporaneous motion for clarification of its order dismissing my appeal. The court however, did not yet rule on my motion for clarification of its order dismissing my appeal.

Customer: Yes. One of the lawyers on your staff had earlier advised me that my claim that the district court did indeed usurp the first instance original jurisdiction of the Colorado Supreme Court; and that my claim against the district court as a usurper is indeed a valid claim.
