VerifiedI am sorry to hear of your niece’s legal woes. Court order’s regarding parenting are not final and are always subject to modification. So she can file a motion for modification to request more visitation, and to request a reduction in child support. Generally the child support calculation is based on a calculation of her income relative to the division of parenting time. So if she is allowed more parenting time that could also warrant a modification of her support payments. When a witness testifies in court they do so under penalty of perjury and the other party has an opportunity to cross examine them to challenge their testimony. If the other parent has the assistance of an attorney then that could put your niece at a disadvantage.
