Building Permit Issued and then found they made a mistake.Denise, I am sorry to bother you but I think it is best to visit with you about a possible upcoming legal situation and the coverages that our home owners policy actually covers and I need definite clarification. You will probably need me to discuss this with the Farmers claims area for clear and concise details. Here is the “Readers Digest” version; I presented plans to the city of Lake Havasu, as a owner builder, about a steel building that was to be built on our property at ************************** City, AZ. These plans were approved ( after discussion and the need to change the “collateral” load on the building to meet what the city wanted. The manufacturer agreed to make the necessary changes to accommodate these load requirements prior to ordering the building and issuance of the permit. The permit was granted on 4/24/2018 and it is permit #******** issued by the Planning and Zoning/Building department of *********** City. I contracted with a cement contractor, electrician, Uni Source to move power lines and bury the overhead line, contracted with plumbers and a steel building contractor and ordered the building exactly as the approved plans show on all material provided to the city. Cement is poured, electrical done, under slab plumbing done, and the building is about 1/3 – ½ completed and the city calls me and said they made a mistake on the permit and that the back 25'(approximately) exceeded the height restrictions, which is limited to 15' if the building is within 50' of the back property line. At the cities request I stopped construction, and have been working with the city to resolve this issue since then. The city initially agreed that Joyce and I would not suffer any financial costs due to their mistake. Anyway, when we told them the cost to remedy their error in permitting, they are not meeting their promised and my building is still partially erected and laying on the ground. I feel I have no choice to retain an attorney, since the city has their own legal representation to get this resolved. Please advise who to discuss this with in the claims department.
