Hi... my landlord and I came up with a agreement (email agreement) in July of 2015 stating I would purchase the home for x amount of dollars. The exact wording is, “ Purchase price of $xxx with escrow to close within 60 days of opening (date to be determined by seller)” I just received a email from her on Thursday stating because of extreme time lapse she is offering the house to me for x amount of dollar which is much higher than our agreement. It states opening escrow no later than Dec 1st and closing escrow no later than Jan 30th 2020. This is the first occurrence she has put into writing when she wants to open and close escrow for the house. She feels because we started discussing getting escrow started in January of this year that that constitutes the beginning of the 60 days stated in agreement and that the agreement is now void. We have a lot of back and forth texts and emails where she admits the communication on her end has been poor and she's been busy with putting her own home on the market and discusses how she will be using money from our transaction into other properties but nothing said on date she wants escrow opened by and closed by. I spoke with my lender months ago and was waiting on her to pull the trigger. Is our agreement still valid or can she now ask for any price she wants? Side note the house was complete fixer when I moved in and completed a huge renovation on it with my own money.… read more
