I have house rented through contract with Agent in Gwinnett County, GA. I live in FL. Agent died 7/21/18. Renter did not pay rent to agent June through August, but agent paid me June & July. Renter's 1 yr lease with agent ended on 7/31/18. Agent has no POA or Executor in place at this time. His son has been asking me to return June & July payments. I want renter to vacate house ASAP, so I can repair & sell it. I read on Q&A Magistrate in County "In order for me to file a dispossessory action, I must 1st make a demand for possession of the premises prior to commencement of the proceedings: I assume that means by demand :A Notice to Quit". I also see on GA Q&A that "If tenant has no lease, that landlord can evict without a reason, but must give 7-30 days in writing". Also, I can give a 3 day notice if renter is at least 30 days past due and at time of receipt of notice, that renter owes at least 2 months rent", which is the case.
