A landlord offered myself and my roommate a property and indicated that the security deposit would be waived in writing. Prior to such, they had spoken to my roommate and only my roommate on the phone and had made reference to an additional security deposit being necessitated. This was never expressed in the subsequent emails confirming the lease agreement terms, their specials, etc. It was not until we received the lease, a week later, and after paying the non-refundable holding fee that we learned that the additional security deposit would be ~$750. Am I wrong that the prior phone call would fall under the parol evidence rule would mean that the agreements made where there was no mention of an additional security deposit and it was stated "security deposit would be waived" supersedes anything previously mentioned on the phone and we would not have the obligation to pay the deposit? Note: I live in colorado, which has strict standards re: the parol evidence rule. … read more
