I’m HIV positive dealing with Bipolar 2 disorder. At time being bipolar affect my work and I have my temper outburst or loose tracks of my meetings. My supervisor already ask me if there is anything wrong and I don’t know how to respond to that and say No. I’m not sure how much I have to disclose for them to respect the fact that I have to go to therapy and get blood work every 3 months. I’m afraid one day they can take my behavior and many doctor’s appointment and fire me. Thank you.

Lawyer's Assistant: Have you discussed the termination with a manager or HR? Or with a lawyer?

I have not been terminated but I have been called to my supervisor’s office to discuss my temperament and they always make a face when I tell them that I’m at a Dr Appointment... I don’t think they believe me. i don’t have a lawyer yet.

Lawyer's Assistant: Are you an "at will" employee? Do you belong to a union?

Advertising agency. No Union. No proteccion

Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?

I’m concerned thy are going to take action against me and fire me because of my be bipolar 2 behavior. Depression. Mood swings. hypomania, anxiety etc. Plus the HIV situation. They misjudg my behavior and loooks. I don’t look sick. And usually I’m a fun guy. I’m afraid they think I’m making everything up.

Hello: My name is ***** ***** I am an attorney.

Being Bipolar is considered a disability. In other words, if it severely impacts your ability to keep a job, you would be eligible for disability benefits.

An employer cannot fire you for being bipolar. At the same time, the employer cannot be forced to keep you employed if you are unable to do the job. The employer must though attempt to make reasonable accommodations for you. Let's say in a less stressful job.

So, yes, if your mood swings affect your performance or ability to interact with co-workers, it could affect your job. However, the employer would have to make reasonable accommodations if possible.
