Hello and welcome to JustAnswer. Please note: This is general information for educational purposes only and is not legal advice. There is no specific course of action is proposed and no attorney-client relationship or privilege formed within this conversation. (You may also be offered a phone call, but those don’t come from me and are offered by the website and you are under no obligation to accept.)

Sorry, but yes. In cases of accusations of domestic violence, spousal privilege is voided. Meaning, you can be subpoenaed to testify and must comply. What you choose to say on the stand is up to you, of course.

An investigator has been trying to get a hold over the last
An investigator has been trying to get a hold over the last few days since 05/09/2017 over the phone to subpoena me to testify against my husband in a domestic violence case on 05/15/2017. I am the victim. He advised me to contact the Domestic Violence Advocate at the Prosecutor's office to voice my concerns as I do not feel comfortable testifying, and this whole ordeal has already caused a great deal of stress and anxiety in me. On top of that I have on family support and I am in the middle of immigration. The Domestic Violence advocate was very pushy, and told me I had no choice in the matter, and I could be held in contempt of the court if I did not show up. The investigator called me again and left a voicemail telling me the details and wanting to meet me. I also called the Prosecuting attorney to voice my concerns about the matter, but did not receive a call back. I would like to know how a subpoena is legally served here on the Island of Oahu? Can it be served over the phone, as a voicemail, can the Domestic Violence Advocate for the Prosecutors office tell me over the phone or via mail? Or does it have to be served to me in person? Please advise. Thank you. … read more
