Customer Question

JA: What state is this in? It matters because laws vary by location.

JA: What steps have been taken so far?
Customer: none
JA: Anything else you want the lawyer to know before I connect you?

it is a live chat

I have looked at the previous question

yes you can sue her

since you were made whole by the bank you can not sue her for the amount on the check

you could sue her for emotional damages but you would need to prove them

My bank reimbursed me, her back Wells Fargo did not and she still technically has the money and got away Scott free. I’m just confused some lawyers told me I could sue for the amount of the check and may even get punitive damages and then other lawyers are saying no. I’m not sure why some believe I wouldn’t be able to sue. What is this girl just suppose to get a free 3500 dollars that makes no sense. Please explain....

In my opinion you can not sue for what you have already recovered

you could file criminal charges and I would suggest you do

you can sue for emotional damages but you would need to prove them which is difficult
