I understand. Well, HIPAA requires that employers do not disclose personally identifiable medical information to a third party without the patient's consent. The information has to not only contain medical information (e.g. diagnosis and test results), but also be personally identifiable to the patient (e.g. your name, address, etc.).

In this case, I don't believe that it was a HIPAA violation because they didn't disclose this information to a third party.

There may be another cause of action. So, have you suffered any adverse affect from having your information sent to the wrong party?

Not sure yet. I wish I could cross reference the number to see who it belongs to.

I understand. Well, if something bad does happen, like a credit card is opened in your name, then this to me sounds like a classic case of negligence if they provided you the wrong fax #. Negligence simply means that there was a duty that the other party owed and they breached that duty in some way. What is most important is that it is proven that the defendant breached their duty of care because that is what mostly determines whether there is a cause of action. Basically, the question is, “Did the defendant’s actions fall below the standard of care for a reasonable person in a similar situation?” If the answer to that question is yes, then there is negligence and you are entitled to damages. In this case, it's arguable that a reasonable doctor's office would have provided their accurate fax number and could have prevented any harm. If there is no harm yet, there's not much to worry about, but keep it in your back pocket.

I do have tangible evidence which is a medical report received from them which has the wrong fax # printed on the letterhead below their logo
