Hi, I received a letter of collection for an account that isn't mine. I relied to the collector agency and they send me a second letter that because I didn't send them enough information like account number, address, etc. they will be reporting it to the credit agencies. How acn I send them account numbers, etc.. if the account is not mine?

Lawyer's Assistant: What state is this in? And when did the issue begin?

I live in Arizona. The first letter was received about a week ago. The response to my letter came in today

I'm sorry to hear about your situation. It seems like there is a cause of action that you may have against this debt collection company. Under the Fair Debt Collection Practices Act at section 1692e, it is unlawful for a debt collector to say that you owe a balance when you do not. If this is the case, then you should send a letter to the debt collection agency advising them that their actions could result in damages paid to YOU, instead of the other way around. In the future, you may want to consider just writing a cease and desist letter (click here) for all collection attempts under the FDCPA. Lawyers use letters like these on the regular basis to enforce their client’s rights. There’s a site that I’ve used in the past where you can find a good template for a demand letter (click here). It only costs $10 and it is way cheaper than litigation. If they continue, then you should file a complaint with the FTC regarding their action.
