I have a question on medical mal practice? Is that available
My husband was recently dismissed/discharged from his pain clinic due to having "Cocaine" in his urine. My husband has consistantly been taking his pain meds since 2008. He has had the same PCP since he was 17-18 years old, which is the doctor who started him on this medication. The only reason he was sent to a pain clinic was because of some crack down on opiod use, which is understandable. I work in the medical field, so I get it. But my husband has the medical records to back up any questions a provider may have (and they always did). He was diagnosed with diabeties at the age of 17 years old...High Blood Pressure. Diagnosed with Heart & Kidney Failuer in Early 2013. Developed into ESRD in 2014, currently disabled, not working, on Medicare and Disability. Has diabetic neuropathy; gout; back pain from ESRD; on dialysis since 2014. Partially Blind (due to diabetes, had retina detachment in both eyes; had a total if about 10 surgeries, in each eye, only has vision in one eye. He has had a total of 3 amputations on his feet (1 surgery, he almost lost a entire foot due to a severe infection). Recently had his thyroid removed last month because the excessive Vitamin D was affecting his bones and the way he walked. He has been a patient at this pain clinic for 2 years (he saw the same Nurse Practioner each time), his NP knew his records, knew his history. Well on his last visit (which was last week), he saw a new NP, because the regular one no longer works there. When she first came in the office, she asked about MRIs, had him bend over, and move his hand, etc. If she read his record just a little, she would know he was not in the office because of a back injury. He has back pain because his kidney doesnt work. Then when she asked about him taking the drug test, he advised her he can not urinate, which is common for dialysis patients; she looked confused. So she gave him a saliva test, waited a minute, wrote a Rx and sent him on his way. Well he gets a phone call today, @ 5pm, when the office is closed, stating that he failed his drug test; he has cocaine in his system??? My husband doesnt drink, smoke (ANYTHING) or do drugs. My concern at this point besides the fact that my husband has to withdraw off of medications he has been on everyday for 9 years; but he has a multitude of doctors that he has to see due to his condition. This can be detrimental to any furture care he receives. I know doctors can not openly admit that they discriminate against drug addict patients, but just image how they'll treat him if they assume he is on COCAINE???? Let me add that my husband is a 37year old African American man, who looks like he is 30 (if that). I honestly think this new NP profiled him the moment she stepped in the room; but to go as far as lying and saying he had cocaine in his system was too far. Is legal action possible at this point? Again my concern is that this will be detrimental to any furture care he gets. Let me also add, that he still goes to his regular PCP (either every month or every 3 months at the latest), wouldnt he have some type of history of cocaine abuse there (if he was really a user). I'm trying to think like a practioner on this issue, but I cant see a dialysis patient, who has never smoked or drank all of a sudden use cocaine. My plan is to file a complaint with Tennessee's Medical Board and my insurance, but first I wanted to know what my options were legally. Thanks… read more
