I am an attorney with 30 years of experience; I hope to provide you information that will help you in resolving your question.

No the loan is still a civil matter. The lender can repossess the car because they have a lien on the title. So even though the loan can not be collected, the lien can still be enforced.

Many lenders do not bother to repossess older cars because the value is not there. In which case you can keep driving the car. BUT you will find that you will not be able to sell or salvage the car when you no longer wnat it because the title is clouded.
