Hi, I was stopped...

Hi, I was stopped by a police officer for expired regristrationbut his first reason was that I was swerving then he said that u was flashing my high beams at my girlfriend's car whom was right in front of me then when he told me that my regritration was expired. So he had me get out of my truck he searched me then I asked him if we could get off the road. we proceeded to the sidewalk and my girlfriend was waiting approximately 10 to 15 yards away also on the same sidewalk then the officer proceeded to walk over and initiate contact with her by getting in her face and started screaming at her which she started to fear for her safety. It was so bad that I asked the other officer to please do something so officer #2 proceeded to approach officer #1 and while approaching #1 was saying to him to get over there and finish what he started and he would talk to her but officer #1 was so encroached in screaming at my girlfriend that he didn't hear him officer #2 had to physically touch officer #1 on the shoulder to get his attention. Then officer #1 came back to me and said that I was being detained cause I was getting loud. I told him that he's the one that's getting out of hand and that he has a gun and we were affraid for our safty he put me in the back of his patrol car and then started to search my truck without my consent

The Police of a Massachusetts town arrest a defendant for OUI and place him in the rear of a marked Police car. The defendant tells then police his vehicle is lawfully parked and can stay in that that spot. The police ignore the defendant and continue to impound the vehicle and have it towed. The police mirandize the defendant whom asks to speak with his attorney. The Police then begin what the arresting officer in his police report describes as an "inventory search" of the defendant's motor vehicle. At the time the vehicle remains lawfully parked in a space at the apartment complex where the defendant lives which he turned into and parked in after the police allegedly follow him there for speeding and driving to endanger. In the locked trunk of the defendant's car the police find a package that had been domestically sent via USPS to someone in that town other than the defendant at a separate address.. It may be noted that in approximately 5 hours a snow storm is predicted to hit that area. The police ask the defendant about the package and he reminds them he had asked to speak moo his later to which the arresting office responds “oh yea." During the “ inventory search” the Police bring a k-9 to search the car. The K-9 is said to show interest in a package but does not hit on it for narcotics. The police seize the package and take it to the police station when they transport the defendant there for booking. At the station the place telephone the person who the package is addressed to. During that conversation the police ask the addressee if the package his. It is unclear what his responses to that question. The police ask the addressee if the package is the defendants' and it is unclear what his response is to that question. The police ask the addressee what is in the package and the police say the addressee says he does not know. The police ask the addressee if they have his permission to open and search the package and the Police say the Addressee clearly says “NO” to this request. The addressee repeated he does not give his permission to the police to open and search the package. Next in the Defendant's police report for OUI Iht police make a Blanket statement that the defendant has an “ MO” f sending himself Narcotics through the US Mail by sending them to names and addresses other than his own. Then to sup[port this blanket statement he begins with stale information involving a case over a decade old that did not involve anything about the mail. The second case involved making something to the the defendant himself in his own name not anyone else name. And the third and final thing the officer mentions is an investigation eleven years after the prior one where something alleged to be steroids was mailed too the defendant's daughter's apartment in the her boyfriends name. The defendant is threatened by the police to say it is his or the daughter and boyfriend will be arrested. Repeatedly tells the police he has no knowledge of what they are talking about. Finally when the police have detained and questioned the defendant for over an hour outside and detained the daughter and boyfriend inside for even longer the defendant says he wished to speak wit a lawyer to which the police tell him he is a bigger scumbag than they thought and left without making any arrests whatsoever. And never returning or speaking of the matter again. That was in 2016. Therefore there had been no contact between the police and the defendant from2008 and 2016. And between 2016 and the OUI rest last week. The police have had the package in their custody for two weeks. The Addressee claims it is his and is seeking its return. The Police say they are seeking a warrant too pent the package. Question: do the Policed have Probable cause and will the legally prevail in establishing Probable cause to open the package? … read more
