We move out of...

We move out of her apartment 1 month prior to our end lease but we already pay it to to end of the month, she wanted the keys which we didn't give because our contract is not up yet and she got mad on us. we leave her apartment clean which I have a pics she charge as so much that we don't have any left for our deposit money and ended up owing her.

Thank you for your post, can you please tell me what your legal question is? Also, can you tell me how long after you turned over the keys to the unit did you receive a letter with the details of the reasons for the security deposit retention? Also, was it detailed by item as to the damages and the costs to repair/replace or clean?

1) Landlord didn't show up for walk-through of conditions as other tenants were moving out & we were moving in. She had us walk through and take photos of specific parts of the townhome. 2)Previous tenants didn't really clean on their way out. Landlord says in lease she'll withhold a "$150 Cleaning Fee" from the deposit at move-out. No professional cleaning or painting was done before we moved in 3 days ago. 3) Not wanting to be held responsible for prior damages,we emailed a list of things that were filthy or broken. 4) We were already mid-move-in. We cleaned a lot, including cleaning from a dog that was forbidden on the prior lease, and we hung a few small mirrors, and a couple of light fabric swaths on the walls, using tiny tack nails and picture-hanging nail-&-hook combos, knowing they cause the least damage. 4)She decided to come for an actual walk-through, said she'd come on Saturday. Instead she showed up for a surprise visit on Friday, and pretty much freaked out for over an hour. She said she'd be taking money out of our deposit because we'd hung a couple of items, and she'd have to have the whole place cleaned and painted and repaired. 5)She said she'd be making many regular visits to check up on us because, she said, "I don't trust you." By phone, you can't tell what my ethnicity is, and she and I had plenty of friendly conversation. In person, she is now a different person entirely. The girls who moved out were white, heavy-partying, messy dirty people with a dog not allowed in the apartment. We are mixed-race women who don't like to assume racism, but this really feels like it this time.Bot***** *****ne, trying to avoid the entire race/ethnicity issue, what are our rights? The lease says we're not allowed to make alterations, including "driving nails or screws into the walls or decorating of any kind," but then there is also the reference to "ordinary wear and tear," which we understand to include small nail holes from picture-hanging. Can she follow through with the threat to withhold our deposit 12 months from now at the end of our lease because we hung a couple of mirrors and pictures within reason? Can she make this threat before we even move out next year? Can she keep a $150 cleaning fee from our deposit if we moved into a place that was filthy and we leave it spotless?
