If I changed all...

If I changed all my information at the bank because of feud activity on my account and they send my new information to the same place that was taking my money can I sue

Lawyer's Assistant: Because laws vary from place to place, can you tell me what state this is in?

Texas

Lawyer's Assistant: Has anything been filed or reported?

Not yet I wanted information first on the steps to take

Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?

That it was sent or updated without me knowing and they told me they can’t do anything about it

Hi,

I'm Zoey.

I've reviewed your post. Did you alert your bank when you changed your account that there were unauthorized fraudulent charges and did you tell them not to allow that creditor to charge anythiing further? Did you contact your bank when the charges came through again on the new account? Did you report the charge as fraudulent? How long did you wait to do that?

I informed them when I changed my account and routing numbers that charges were on my card that I didn’t authorize on Oct 10,2017 and charges posted on my account on Nov 20 , 2017 I called the bank immediately and she informed me that because it’s my gym the bank automatically sends my new information over to them , but haven’t been at that gym for almost 7 Months . I also went to the gym spoke to the gym and said the bank sent over my new information with out consent from me and she would try to refund it , but it’s been two day and the bank said I have to wait for the withdrawal to post then sent a fraudulent post made and I asked how long will that be she could inform me of that information

So your bank hasn't denied you a refund. You just have to wait for the withdrawal and for the report, is that what you've said?

If you aren't damaged, you wouldn't have a lawsuit. So if either the gym or the bank refunds your money and you instruct your bank specifically that you no longer have a membership at the gym and want no further charges and open up another new account there really isn't anything to sue for.

Otherwise, if the bank finds against you, yes, you could take legal action against the bank.
