I meet with her lasts week and i have given her all the facts and i noticed on pacer in exhbit A there is only two EEOC right to sue charges and she left off one . i have three right to sue letters and she has been given all three and i pointhed out to her that the very firsts EEOC right to sue letter was not in the complaint under exhibit A. the right to sue letters state that i have 90 days from the date to file a suit. i pointed out that to her that there is one charge not there in exhibit A. my atty said no problem i can amend suit and she stated since she has not served the company it can be amended. my problem is the 90 day right to sue letter and it has been more than 90 days on the one EEOC right to sue letter and it is a big part of my case. my atty stated she can amend because they have not been served the charge. my question is can the charge be amended and the EEOC right to sue letter added to compaint? my next question is how much time will the court give my attorney to serve the organization my charge? does my atty since she has not served the complaint amend the lawsuit concerning the EEOC right to sue letter? yes… read more
