We are in a situation where we would like to sell a property
We are in a situation where we would like to sell a property in California that is in a trust account for my parents. Dad is still in charge of the trust and I am on second and mom is passed. My question is we want to sell one of the properties basically because the area it is located is heavy gang neighborhood. It is a rental and honestly I don't even want to go into that area any more. I was raised in the house. Anyway, I have power of attorney over dad which includes selling real estate. I want to do a straight 1031 exchange for another property rental in a better city. 1. Can I do that with the power of attorney 2. Any tax issues because of a trust. 3. Do we keep the new property in dad's name for the deed etc . I just need some guidance because I really want to get away from this neighborhood. Sandy … read more
