I have a very complicated situation. my so co signed on a car with me back in 2007, he went to the army and was supposed to continue to pay for it while he was away, but he didn't. I eventually learned about the soldiers and sailors act and how that would protect him while he was away. He came back and the car was waiting for him. He continued to drive the car he had insurance on it and got into a couple of gender benders. He eventually moved back home but showed up with a different car and he told me the car was at a friends house and it still had insurance and that it was taken care of. I never got any paperwork on the car so Zi thought it was handled. I recently got a call from a PI looking for the car. My son doesn't speak to me and hasn't for years, do now I understand he abandoned the car in NY and he will not take any responsibility. I don't want this to fall on me solely. I need guidance

No, it is extremely unlikely it could provide any relief at this point. The SSRA is an affirmative defense but it doesn't allow someone to hide property on which there is a security interest.

He needs to hire a lawyer ASAP and have them work on the case for him. If there is anything that the SSRA applies to, and it doesn't sound like there is at this stage, then the lawyer can assert it but what is likely to happen next is he will get indicated for "hindering a secured creditor" or whatever it is called in the state in which they decide to file charges. That is the crime used when secured property is sold or hidden from the creditor who has the secured interest.

A lawyer isn't under an obligation and can't be made ot reveal anything he knows which is the reason your son would want to use him rather than you trying to handle it or using a PI (or anyone other than a lawyer) simself.

My main concern here is that they are likely to charge you as well as your son if someone doesn't reveal the whereabouts of the vehicle.
