Does the time between when someone threw my stuff away and when I found out that my things were thrown out affect me getting a ruling in my favor?

Someone threw my stuff away and shouldn't have. I think it may have been a while since the things were thrown out. If there was a significant amount of time since the items were thrown out, could my case be thrown out.

As long as it is within the last 2 years or so you should be fine.
