If I "borrow money" from my partner and he accepts partial

Customer Question

If I "borrow money" from my partner and he accepts partial re-payment does that constitute him accepting that it was a loan although he is trying to now claim theft? Complicated situation...also is his not threatening to evict me or go to the police extortion?

Good day. I am Loren, a licensed attorney, and I look forward to assisting you.

That would be evidence of a loan, but it could rebutted by the partner. It would depend on all the evidence which you could present to show you and your partner understood at the time you received the money that it was voluntarily given as a loan.
