When a motion of reconsideration is granted in the higher court (circiut), do they lose jurisdiction if the inmates case was never finalized and was transferred because she was pregnant within two weeks of being in local jail? Her semtence hS been suspended but DOC wont release.

If the higher court did not return the case to the lower court, the higher court retains jurisdiction until they enter a final judgment in the case. Until the motion for reconsideration is heard and a new final verdict is entered nothing is done. The circuit court does not lose jurisdiction just because the inmate was transferred and not finalized because she was pregnant.
