Our geothermal heat pump was destroyed by service repair

Customer Question

Our geothermal heat pump was destroyed by service repair person by using an incorrect refrigerant. It is unreapairable. The estimated cost of replacement is 10,000-15,000$. The owner of the company is proposing that he and his refrigeration subcontractor that caused the damage replace the unit, but wants us to pay 1/3 of the cost (4-5,000$).
What should our next step be? We do not feel it is right that we should have to pay anything. We paid him 1200$ and it was damaged, then we paid a second company $500 to diagnose the serious problem they caused. Thank you,

Hello Jane:

You are correct. You are not liable for any of the expenses caused by the damage. The company's proposal should be rejected and a demand made for the company to pay for the cost to repair the damage. Also, because of the company's track record, it is prudent to get another contractor to handle the repair and bill the company for the expenses.
