I filed an assault against my daughter in Louisiana. I want to drop the charges. She signed a $5,000 retainer fee to this lawyer. If he only did a one hour consultation, is he allowed to keep all $5,000.

Don't be so quick to discharge the lawyer because the DA can refuse to let you drop. And generally with domestic charges they give complainants a hard time and won't do so right away, if at all.

But in answer to your question, if the lawyer doesn't do any work on the case, you can try to negotiate a refund. If he doesn't agree to refund anything the Louisiana bar has mediation services when there are disputes as to what a client should be charged. You can read more about that here.
