Wiretapping is actually illegal under both federal and state law, so a defendant could be penalized twice for wiretapping someone's phone. In Nevada, it is a category D felony, punishable by 1-4 years in jail and/or a fine of up to $5000. The person(s) wiretapped can also sue the wiretapper for $100-$1000 per day plus punitive damages. Violation of the federal wiretapping law carries up to 5 years in prison and a fine as well.
