I missed he 9 day filing requirement Opposition to demurrer.

Customer Question

I missed he 9 day filing requirement for my Opposition to demurrer. Can I still file it? Or what are my best options?

File it anyway (right away!). While it is late, and the other party is going to argue (rightfully) that it should not be considered, the court is more likely than not going to consider your late filing (as long as you are getting it in right away).

Thanks - do you know where I can download a basic form Opposition To Demurrer

This is not a form based motion, so you will need to draft one yourself. You can find examples doing online searches, but your best resource is the local law library (the Sacramento law library has a good primer on how to draft motions online)..
