LAW (Lawsuit potential) sidewalk pavement QUESTION: Government

This answer was rated:

LAW (Lawsuit potential) sidewalk pavement QUESTION:

Government office in charge of sidewalks obligated us to fix a crack in our driveway. During the meeting, the representative said that if someone tripped and fell, we would be responsible. While this crack will be fixed, there are other superficial cracks that concern us. We are already edging beyond our loan amount. So if we don't include fixing the rest of our sidewalk, would we be responsible if someone tripped, purposefully or accidentally? Or would our home insurance cover such a lawsuit? (We do intend to fix it later when we have more funds.)
Hello, and thank you for contacting Just Answer. I am an expert here and I look forward to assisting you today.

Just because someone trips on a crack on a sidewalk or driveway on property you own doesn't make you automatically liable.

In addition, a policy of Homeowner's Insurance usually will cover accidents like this.
