We refinanced our existing home loan in October. The old lender

We refinanced our existing home loan in October. The old lender said they will hold escrows for 30 days before releasing. That was Nov 17. They stated the check was mailed Nov 19. Have not received anything as of today. We are in Virginia, do we have any recourse?
Yes of course. You would simply sue the escrow agent for breach of contract. However, the best thing to do is simply get the escrow agent to reissue the check.

Contact them and tell them that you are going to sue them unless they reissue the check and send it to you express.
