If a residential lease agreement states in the general description

This answer was rated:

If a residential lease agreement states in the general description "From:" which is a date to another date (one year) and below under "Terms" are 2 boxes, one has "until" (a date of 1 year from now.) and the other box states "month to month". Neither box is checked so is this a 1 year lease or month to month?

Welcome! My goal is to do my very best to understand your situation and to provide a full and complete answer for you.

Good morning. Are there specific dates listed under the "date to another date?"

Customer: replied 5 years ago.
Hi, Thanks for responding so quickly.
Yes, the dates are specific dates.

Thanks...In that case, the specific is going to control the general and the court is going to determine this based on the facts it has to determine the intent of the parties. If the specific dates are filled in, it is going to be presumed the parties intended those specific dates to be applicable and that a one year lease was intended.
