If I'm working in a hospital or clinic setting and I access a patients medical record while I'm not "on the clock", could I be in violation of HIPPA?
It depends.

For what reason are you accessing the medical records?

I'm a RN. Patient charting.
Then you're fine. As long as you are accessing the medical records to further the treatment of the patient in your role as a medical provider, it doesn't matter whether or not your are on the clock under HIPPA.

That being said, the facility may have stricter rules for patient privacy compliance. You should check to see if there are any hospital policies which forbid you from accessing the records while not officially on duty.
