A copyright would not be applicable in this situation as a phrase is not long enough to qualify for protection. A phrase can only be protected by copyright if it is part of a longer piece of original work.

Nevertheless there is intellectual property law protection available for you under trademark law

You can register the phrase and the shirt, along with the type in which it is written, design, color, etc, with both the state and federal offices. This is a process which costs money and takes filling out an application form, but it is allowed.

Of course, if there is someone else who is using the phrase first, then you cannot get the trademark.
