My husband and I moved...
My husband and I moved into a rental house where the floors were in bad shape and there were clearly water stains on the walls and ceilings left from various previous water leaks. They assured us that a new roof had been put on the house not more than 2 years before we moved in and that the tenant who lived there before us had been there 5+ years. So they were going to take care of everything before we moved in.
On moving day the previous tenant still had more than half of his items in the home, the carpets weren’t cleaned the walls weren’t painted and I was more than 7 months pregnant at the time. After attempting to get out of the lease
we ended up just pushing the movers later in the day (which resulted them not moving everything and us having to hire a second set of movers at our own expense to move the reminder of our items the nest day). The management company put us up in a hotel for the night only for us to return the next day with the second set of movers to come head to head with the poor attempt to clean by maids that were there less than an hour also trying to work around a carpet cleaning company who suggested we don’t put any of our furniture on the wet carpet for 24 hours. Well we ran out of floor space not to mention we had to set up the bed just to sleep.
Needless to say....over the next few days painters came to paint and we had to move our furniture and boxes away from walls so they could paint. The management companies son was there re-doing the upstairs bathroom walls where all of the paint as well as wall paper was peeling off. Unknown to us at the time there had been a water leak in the upstairs bathroom that sat for more than 3 days before it was addressed. There were even stains all over the walls in the master bedroom from this leak. They merely painted over everything but told us it was all fine and had been properly take care of.
Well in the months following my husband and I were sick all of the time and once my daughter was born she too began sneezing and coughing for the next 6+ months. She stayed at home with my husband until such time when I put her in daycare. Once she was in daycare she was actually in better health than when she was staying at home all the time. Upon examing the upstairs bathroom wall you could clearly see something growing on the paint in a 2ft X 2ft area. Also in the down stairs bedroom, if you stepped back to look at the 15ft long wall you could clearly see a 3-5 foot wide section (from the wall joint to the first stud) &spanning the height of the wall--had a grey tint where the rest of the wall was white. This grey tint spanned from the entire section of the wall. I put out petri dishes and sent them away and got mold reports. I sat down with the management company with the mold reports and more than 15 photos of the numerous water stains and discoloration on the walls. They told me it just needed another coat of paint and not to worry about it. Eventually a sample was taken from the 'grey' wall. This report stated essentially that mushrooms and other fungus were growing in the wall and to contact the local environmental agencies. The only response from this management company through all my phone calls and meetings were, "find me a house in Florida that doesn’t have mold" and "you know you need to watch what you say if the wrong people hear you say the word mold they will just evict you and you don’t want that on your record do you" and my favorite of all was..."when you show this house to other people you need to make sure that you don’t mention the word mold." We moved out 15 days early (but paid the full months’ rent and left the utilities on until the next month) because my 7month hold had bronchitis so bad she had a nebulizer she used 4x times a day. We left the house spotless, gave them a 120 days notice via certified mail when they refused to let us out of our lease, I even left the water on until the 11th of the next month when they moved a new tenant in.
**So I have not gotten my deposit back... Its been 30 days and I haven’t even gotten a certified letter...Does it just need to be post marked within 30 day of the lease ending?
**Since I didn’t get in within 15days I assume they are holding money for something... but for what? and are you kidding me after all that we went through?
**I found the actual owner of the property’s son who is a landlord/tenant lawyer...should I approach him for how the property is being cared for?
Please help. What do you suggest and do you know anyone in Orlando that you could suggest to help me?
So lost, tired and angry that my family suffered for so long due to the negligence of others.
