A student was identified as mentally retarded by a previous district. Upon reevaluation the school psychologist disqualified the student as an MR or LD student. The school psychologist did note inability to focus, attention issues as seen by the previous district and recommended to the parent to pursue an appointment with their family doctor to explore a medical diagnosis and intervention. The school psychologist also stated that if assessment tools to explore other health impaired are not listed on the permission to reevaluate form then she would not do the assessment. Under the district's policy a student who is looking at a change in educational disability is exited from special education and the change is considered an initial evaluation and must go through the IST process before being evaluated for special education. Can you comment on the legalty of thier use of RtI procedures and identification process for special education?
