Yes, you can just call him up and say that he's fired. Now he will have to file a Motion to Withdraw with the court, and you can agree to this motion. But what I would do is to call him up, tell him to withdraw your plea of guilty, at his own expense, because he had no authority to plead guilty on your behalf.

He may or may not do this.

But you can still have him withdraw if you do not feel that he is able to represent your interests.

If it is determined that he knowingly filed a guilty plea when he should not have, then he can get in big trouble.

Even if he negligently did it, he could be liable for certain expenses related to it.

That's why it would be best to tell him to fix this situation, at his own expense, otherwise you will file a complaint with the state bar.

In terms of fixing this problem, if he won't: you can get another attorney to file a motion to withdraw plea. That way you can enter a plea of not guilty.

I think I will have to send a registered letter today because I went to his office last week ,Tuesday afternoon ,and his secretary said he was is court (his pickup was parked in the office lot) . She promised to have him call me (this is my son's case and they hang up on him when he calls so now I'm involved),he did not call. Then I called the front desk to make an appointment to see him and the receptionest said his secretary was out and she is the only one that can make appointment's for him.She told me to leave a voice mail and they would call me the next day--needless to say I have not heard from them. I am really irrated by now.

The best thing is to document everything and threaten a complaint to the bar association. Lawyers can get disbarred for not returning phone calls. So this is something that they should take very seriously.
