Hello again. No, you don't need a lawyer for this. You can file a small claims action yourself for up to $7,500 in California, so if you list the value of the dogs at $600 per dog (as an example), then that is $1200 -- so you are well under the cap for a small claims action (remember what I said in my earlier post about the dogs being personal property -- so the price that you list for a "value" is what you would pay for each dog from a breeder). You can sue her in the court where she lives or the court where you live -- my suggestion, however, is to sue in the court where SHE lives and bring large enough transportation with you to bring the dogs back with you just in case the judge decides in your favor that day and you are then closer to where the dogs are and at the court hearing ask the judge to make her turn them over to you right after the hearing. If your witness has difficulty getting to the court in her county, then you can get a sworn statement from the witness of what he knows regarding your ownership of the dogs and bring it with you -- in a small claims hearing a judge is freer to accept what evidence they want to accept and can review the sworn statement. (Statement just needs to be typed up, dated and you start it with "I, XXXXX XXXXX, do hereby swear under oath as follows: 1. I have known the parties for X years, 2., 3., 4. -- you set the statements out like that in numbered sentences/paragraphs. Then, at the end, you type in before the signature: "This affidavit is signed under the pains and penalties of perjury this ___ day of July, 2010" and then have your witness sign and print his name, with an address and telephone number underneath -- it does not even have to be notarized!). Again, it is your decision where to file the action --your county or her county, but her county is closer to where the dogs are kept so you might be able to have them returned on the same day.
