What is your fee? I have a situation where I hired a
I have a situation where I hired a contractor to remove existing flooring in 3 adjacent rooms (2 with hardwood and 1 with carpet) and replace it with prefinished hardwood that I provided. I stipulated that the job be completed while my wife was out of the country during the first two weeks of October. I received an estimate broken down in 3 phases. 1. Removal of flooring (including moving of furniture and appliances. $725. 2. Installation of underlayment, flooring, new quarter round, reset furniture & appliances $1800.00 3, Paint new quarter round & fill nail holes. $225. TOTAL: $2,750. I gave the contractor $1950 up front. After promising to start on 3 occasions, he came and removed the flooring and promised to return the following Monday to remove staples, etc. where the carpeting had been. He did not come . I called him & he came Tuesday & removed the staples, etc. and promised to return the next day (Wednesday) to begin installing the flooring and return on Saturday to complete the job. He did not show on Wednesday. My wife was returning on Sunday and my house was in shambles. Furniture crammed into on space, etc. I was living like a squatter in my own home. Based on his past history of not showing up when promised, I was not willing to take the chance that he would show up on Saturday & even if he did he would not likely complete the job in one day. I could not take the chance with my wife returning the next day. I went online and contacted Home Advisors, a company that connects you with proven professionals that they have vetted. I was able to find a flooring contractor who promised that they could come on Saturday with a full crew and complete my job. So I hired them and contacted my first contractor & told him that based on his un-reliabliity (?) I was firing him and had hired another company to complete the job. I told him to come and pick up his equipment and bring me the remaining portion of my pre-payment of $1950 minus $725 for removal of the flooring. He said there would be no refund because he had completed half of the work. I told him that in accordance with his estimate he owed me the refund. After further discussion, I told him he was fired and I would file a small claims suit to recover my refund. He said cool. I have filed but am concerned that I may not prevail because he says I fired him before he was allowed to complete the job. My stand is that he failed to show on several occasions and I had reasonable concern that he would not show on Saturday plus he never worked on Saturday before. What do you think my chances are of recovering my refund? Also what is the legal term for "You cannot demand money for work you did not do"? … read more
