If you change your statement you could be criminally prosecuted for a variety of things. The possible charges could include filing a false police report, resisting/obstructing an officer and perjury.

Assuming the first statement you gave was truthful, it would be prudent to stand by that statement.

ok so assuming i get charged for filing a false police report and what not what could happen? and what would happen to my son?
Lawyer: Joseph, Attorney replied 8 years ago

The penalties would likely be relatively minor. I assume what you're getting at is "would my penalties be less than the penalties for the other person?" While the answer is most likely yes, I certainly wouldn't recommend committing one crime to help another person avoid another crime.

Your first post mentioned an ex boyfriend and a girlfriend. So I don't know how your son fits into this equation.

so we lookin at some time in jail or prison? and a fine? or what? and im conscerned about what will happen to my son if i get sent to jail...where will he go? who will get custody of my child?
Lawyer: Joseph, Attorney replied 8 years ago

Please explain your son's involvement in this matter. Actually, to make it easier to understand, please give me names (fake names are fine) and relationships so I can better understand the situation.

Thank you.

ok well me and my exboyfriend jim have a 6month old child together..we recently broke up so im a single mother taking care of my son...i have sole custody of my son..now to the incident..about a week ago i ran into my ex jim n his new girlfriend pam we got into an arguement and i was hit in the face...now i intially thought jim hit me and another 2witnessess that were there said the same thing but we were not totally positive either way i went to the hospital and the cops got called we gave a statement against my ex jim till recently i started getting calls from his new gf pam saying that she was the one that hit me...so now when i really thought about that nite we i did recall a ring strike my face in result i had a deep cut under my eye...so when i went back and told the officer he said if im goin to change my story i could get arrested for perjury...now if that were to happen i want to know what could happen to me if i insist on changing my story? and since i have custody of my son where would my son be taken if his father doesnt want to take custody of him?
Lawyer: Joseph, Attorney replied 8 years ago

Based on the new information, it seems that the desire to change your story is based on an uncertain memory, as opposed to the desire to protect someone else. In this situation, with you being uncertain as to what took place, there would be nothing wrong with changing your position.

You would simply tell the officer what you've detailed here, the description you provided that day was based on what you believed to be true, after thinking about it, you realize that certain things may not have occurred as you believed. That is not perjury, that is simply clarifying your memory of the events.
