A late charge rental question. My one yr lease started 3/2 and ends in 2 weeks. In the lease contract it specifies a monthly charge for rent, trash, and sewer/water. My monthly payment has been early or on time every month. The contract states rent must be paid on or before the ( ) day with 3rd typed in or is late and subject to an initial 75 late fee. Plus a ( ) left blank late fee charge per day till paid in full. There is a similar statement saying utility payments must be paid within ( ) left blank days of due date or 75 late charge. That's the contract, here's the question. At the start sewer/water charges seemed high. I asked management who refused to explain how calculated, just pay what billed. I called water co who said seem high and they can charge me whatever they want. Apparently they combine all into what they call rent. Monthly payment on time every month but a few dollars water/sewer short. Later in year I found I was being charged 75 late fee each month. Beginning of November I called the co doing water billing who took 5 mins to explain what management refused, that I was paying correct minimum since not using much water. Using their figures I calculated how much water/sewer short and gave them a check bringing water/sewer current year to date. Also starting November 1st I not only made total rent payments on time but for the last 5 months over paid each a little. Now the question: As of Nov 1st all rent, trash, utilities current year to date so only amt due is accumulation of late charges. There after made each total monthly payment not only on time but over payment and I continue to get late charge each month. Is that right. What can be done? Thank you. … read more
