If two parties agree to a binding mediation in a civil case

Resolved Question:

If two parties agree to a binding mediation in a civil case arising from a claim of sexual harassment, can the accused party later investigate and pursue the other party for fraud, and if so would the alleged defrauding party be allowed a chance to repute this claim in court?

Thank you for the post, generally the defending party in the harassment suit would force the suing party to sign a waiver and release agreement which would preclude any future claim basedon the same set of facts. IF this was not done, the plaintiff could sue and the defense would have the opportunity to dispute the claim.
