Hello heroeannabe,

Restaurants are allowed to adopt policies regarding the responsibilities of their employees. And if it is understood that it is the waiter/waitress' duty to secure payment from customers, then yes, they can require the waiter/waitress to pay. It would be similar to an employer deducting from an employee's pay if the employee broke something on the job.

So essentially, if it is a busy night, and you have to help other tables and need to turn around to do so, and a tab of several hundred dollars gets up and walks out- At this point it does not matter that you did not make enough in several shifts to cover this bill? The restaurant has full right to screw the workers this way?
