We are renting out our condo in Santa Monica, California. We have a tenant that has not paid rent. He texted us back in May saying that he is unable to pay due to Covid. Which is fine, I think. As for September and October rent we have requested that he sign and return a declaration form we sent and also provide proof that he can't pay due to loss of income since he is a "high Income Tenant". We sent him a copy of his rental application as proof he makes $100,000. As of today he hasn't sent any forms. I know he has until 01/31/2021 to pay 25% of rent that is owed between Sep thru Jan '21 under the AB3088 law. My question is, what our options at this point? Should we send a formal 15 day notice? or wait until 01/31/2021 to do this. We also requested that he send us a declaration form for the Protected Time Period of March 2020 thru Aug 2020. Again we haven't received anything. Just a text back in May. Btw he is a lawyer by profession. … read more
