I have a landlord tenant hold over case. New York city and
I will describe: I have a tenant that is living in a house for 7 years. when we signed the original lease 7 yrs ago, we signed a lease for 2 years , and I never renewed the lease with him. In Sept of 2019 I sent him a 90 notice to vacate at the end of 2019. He owed rent from July 2019 (rent at 3600 per month)until nov 2019, so I also sent him a non pay notice that I want to evict him for non payment. He came to court on 1/02/20 for the non payment case , and we made an agreement in court a stipulation agreement, that he will pay me all the back rent for 6 months, plus every month he will pay me on time , and i will let him stay until end of Dec 2020. It was written in the stipulation agreement that I will get now a warrant for a marshal to evict him if he doesn't adhere to all the specifics of this agreement, either for non-payment on time or if stays after Dec 31 2020(holdover).I do not have to come back to court anymore. I know there is a moratorium on evictions in NY until the end of Aug 2021. The tenants lawyer is saying now, that because the index # of the case and the title of the case is non payment case, only the part of the stipulation agreement that pertains to non payment is enforceable by the warrant, and not the holdover part that refers to the holdover part that specifies that he has to vacate on Dec 2020. My lawyer says that it was written specifically in the agree that he will vacate and we ordered the marshal for both. What is your opinion? … read more

We have a tenant in Las Vegas who hasn't paid rent since Oct. We don't have a updated lease with him. He has lived on a trust fund that ran out in August. In Oct he sent us a COVID Declaration form that renters could fill out to be protected. We have spoken to him and he said that no one can force him out because he is protected. We do not live in Las Vegas so we are trying to do things remotely. In Dec. he filled out the CARES Program paperwork and they sent us paperwork to fill out only to be denied.
